The Sentencing Court , chaired by Judge Cándida Fleitas and made up of Judges Juan Carlos Zárate and María Fernanda García, decided to sentence Flora Irene Giménez Cáceres to seven years in prison, after finding her guilty of aggravated theft of a millionaire lot of jewelry.

The woman worked as a housekeeper for Nicolás Latourrette Bo , director of the Museum of Sacred Art , who in December 2019 reported the disappearance of several jewels valued at US $ 800,000, pointing Giménez as a suspect.

The Public Ministry was represented by the fiscal agent Esmilda Álvarez , who initiated the investigation and later defended the accusation of aggravated robbery against Flora Giménez during the oral and public trial. The adhesive complaint was represented by the lawyer Santiago Rodas .

Regarding the woman's sentence issued by the referee, Judge Juan Carlos Zárate informed ABC that technically it was a case of aggravated theft, because the “theft of objects that were protected under a security system occurred; the victim's house is almost a fortress that was violated by the person who pretended to be a housekeeper”.

As for the victim, Zárate explained that “he is an older man, he had the jewelry stored in his closet. Sometimes the key was forgotten in the wardrobe, but the bedroom was locked and this was used by the housekeeper to enter. Many times she was alone in the house, because the man was alone”.

In addition, she “managed the closed circuit, also the guards, because the man, owner of the house, was there, and then she was there. That was useful."

Then the housekeeper's house was searched and towels, $1,000 tablecloths, a commemorative jewel that was a silver star were found. “That was appraised and reached a value of US$5,000. There were other objects reported as stolen, but could not be recovered. Everything about her was pointed at her,” the judge described.

Regarding the objects found, the judge stated that Giménez had said that Mr. Latourrette had given him and that there were others that he took to her house to wash them; however, “the man denied that he had given him those tablecloths; moreover, he stated that these things were not washed”.

"She stole because she had that confidence from the man, she behaved like the owner and mistress of the house, according to the version given by several witnesses," added Zárate.

Zárate also reported that the woman's cell phone was found, “but when she was asked to hand it over, she gave a new cell phone with WhatsApp photos, but without the application installed. In addition, a plan of the house was found”, it is for all this that “we gave credibility to the victim” and the housekeeper was proven guilty.

will appeal the sentence

For his part, the defense attorney for Flora Irene Giménez Cáceres , Miguel Said Bobadilla , announced that he will fully analyze the sentence issued by the Sentencing Court and present his appeal in the coming days.

The justice assistant pointed out in relation to the case that “this lady was never given the opportunity to defend herself against her, neither in the media nor publicly. In January 2020 it all started. She was called first to testify, then to an investigation, she was charged and then went to preliminary. All this monitored by the media and listening to a single bell.

“From our point of view, the procedure started badly, because the jewels of Mr. Nicolás Latourrette Bo disappeared, for whom they were worth US$800,000,” said lawyer Said.

At another point he added that, once the woman had been charged, "Mr. Latourrete never noticed that other jewels were disappearing." Subsequently, the suspects in the process were subjected to the polygraph test, remaining as the main suspect in the case, Said said.

Said pointed out that only 15 days passed between the disappearance of the jewels and the raid on Flora Giménez's apartment. At the site, a tablecloth was found in a corner and on it were found bijouterie-type jewelry, a silver star, blackened and broken, as well as old candies that were taken as evidence.

The woman had pointed out that her own patterns had given her that tablecloth and she also used to bring other tablecloths to wash them.

Regarding the articles found among the tablecloth, Said pointed out that they were trifles and for that reason “I offered the appraisal expertise of these. One of the experts excused himself and another finally subscribed to what the expert of the complaint said; they said he was a star of great artistic value.”

He questioned the fact that his client was sentenced to seven years, in the event that "none of the jewels reported as stolen was found in his house", then, "I do not know if he was sentenced for those objects or for the presumption of that she would be involved in the robbery.”
